Welcome to Smargasy Inc. These Terms of Service (referred to as "TOS" or "Agreement") govern your use of the Client Connect Suite platform, products, and services (collectively, the "Site"). By accessing or using the Site, you agree to comply with and be bound by these TOS, along with our Privacy Policy.

1. Services Provided

Smargasy Inc. offers an All-In-One marketing software designed to organize business contacts and automate sales and marketing tasks, including but not limited to sending text messages, emails, and making phone calls. This software, referred to as "Client Connect Suite," includes a CRM, SmartLists, Email, SMS, Outbound Calling, Call Tracking, Form Builder, Survey Builder, Funnel Builder, Website Builder, Online Scheduling, Automation Campaigns, Reporting, and more.

2. Use of the Service

Your use of Client Connect Suite is subject to this TOS. You understand and agree that the software is provided "AS-IS," and Smargasy Inc. assumes no responsibility for any issues related to timeliness, deletion, delivery, or failure to store user communications or settings.

3. Modifications to Terms

Smargasy Inc. reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Site after such changes indicates your acceptance of the revised TOS.

4. Changes to the Site

We may modify or discontinue any aspect of the Site, including its content, services, or features, at any time without notice.

5. Registration and Account Security

To use certain features of the Site, you may need to create an account ("User Account"). You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Notify Smargasy Inc. immediately of any unauthorized use of your account.

6. User Content Guidelines

The Site may contain forums, comments sections, or other interactive areas where you can post content ("User Content"). By submitting User Content, you agree not to post content that is illegal, offensive, or violates the rights of others. Smargasy Inc. reserves the right to remove or edit User Content at its discretion.

7. User Conduct

You agree not to engage in any conduct that could damage, disable, or impair the Site or interfere with any other user's enjoyment of the Site. Prohibited activities include, but are not limited to, impersonating others, violating any laws, or harvesting personal information from other users.

8. Intellectual Property Rights

All content on the Site, including text, graphics, logos, and software, is the property of Smargasy Inc. or its licensors and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content on the Site without our express written permission.

9. Outbound Marketing Costs

In addition to the subscription fee, you will be billed separately for phone, email, and SMS services. Detailed rates are provided on the Site, and additional charges may apply.

10. Complimentary Credits

Complimentary credits are provided monthly for SMS, emails, and phone calls. These credits are non-transferable and do not roll over to the next month. A minimum wallet balance is required to use the services.

11. Hardship Extension

Customers facing financial difficulties or personal hardships may request a one-month extension on their subscription. This extension is subject to approval and can only be granted once per user.

12. Jurisdiction and Governing Law

This Agreement is governed by the laws of the State of Florida. You agree to the exclusive jurisdiction of the courts in the State of Florida for any disputes arising out of this Agreement.

13. General Provisions

This Agreement constitutes the entire agreement between you and Smargasy Inc. regarding the use of the Site. It supersedes any prior agreements or understandings. Smargasy Inc. may assign this Agreement at its discretion, but you may not transfer your rights or obligations under this Agreement without our consent.
